Calcutta Supreme Court calls for central forces to be deployed in West Bengal
A public interest petition has been filed with the High Court in Calcutta regarding violence in various parts of the state of West Bengal following the Assembly elections, 2021.
The plea was filed by a Lawyer Anindya Sundar Das through lawyers Uday Sankar Chattopadhyay, Debopriya Samanta, Santanu Majhi raising the complaint that the life and liberty of the population are in danger due to the alleged inaction of the police.
The bench of Acting Chief Justice Rajesh Bindal and Judge Arijit Banerjee will take charge of the plea for a hearing at 2 p.m. today. The plea involved the Union of India, the Election Commission of India, the State of West Bengal, the Director General of Police, the Commissioner of Police and the Chief Electoral Officer of the Government of Bengal West Kolkata as Respondents.

Advocacy has attacked the respondents’ actions in failing in their respective duties to end the relentless violence of the post-Assembly elections in West Bengal.
The plea argues that the Activists of the ruling party after the declaration of the result attacked the homes of activists and supporters of opposition parties and that tThey ransacked and looted properties and physically assaulted innocent people who only voted for an opposition party according to the assessment of local ruling party leaders.
“In fact, after the general election, certain kinds of violence usually occur in West Bengal, and the administration takes an active part in preventing such violence, but now the sad state of affairs is that the local hooligans on behalf of religion attacked the supporters of the opposition party who, by birth, belong to another religion. In fact, these innocent people in distress have been driven from their localities. Their livestock, including chickens, birds and other economically important domestic animals were stolenSays the plea.
In addition, the advocacy also raises the issue related to fake news being disseminated on various social media platforms. thus causing disagreement between different communities and religions within the state of West Bengal, and the state administration is only keeping silent on the whole issue.
The plea also asserts that Post-Assembly election results statewide in West Bengal state of affairs was horrible by nature, with the police personnel being absolutely callous and stupid spectators in the bloody situations that unfold between the different political parties, leaving people dead.
Importantly, he also submitted,
“reDifferent members of political parties oppose because of death, serious injury and all other heinous activities caused by them which hamper the daily life of ordinary people in West Bengal state and they continue to resort to such activities inhumane in making the law. and order the situation in their own hands.“
Finally, he maintains that the situation of law and order is somehow paralyzed and people are witnessing the state of West Bengal as the state without a guardian which is a sign of insecurity for them and as the state police personnel were not able to guarantee the situation peaceful post-election results so far, they should be hoisted by this Hon A tribunal and CBI investigation can be headed.
Prayers in Advocacy
- Order the authorities questioned to take immediate action to end the ongoing post-election violence throughout the state of West Bengal;
- Order the authorities to initiate an independent and impartial investigation by a Special Investigation Team (SIT) established by the Hon’ble Court into the issue of post-election violence throughout the state of West Bengal;
- Order the respondent authorities to hand over the investigation into the ongoing post-election violence in the state of West Bengal to the Special Investigative Team (SIT) and to file a report thereon in the Hon’ble Court;
- Order the UNION of India to deploy adequate central forces in areas of concern in the state of West Bengal for at least one month;
- Ask respondents to provide adequate compensation to the families of deceased victims.
